General Terms and Conditions of JL Consulting Group GmbH

Minimum age (18+) Our shop is open exclusively to customers aged 18 and over. If we have doubts about the accuracy of an order or suspect misuse, we may refuse or cancel it.

1. Who these terms apply to These terms apply to all purchases made by private individuals in the Dampfwelt online shop at www.dampfwelt.ch. A "consumer" here is any private individual buying for private, non-commercial purposes.

2. How a contract is concluded What you see in the shop – descriptions, prices, images – does not in itself constitute a binding offer, but rather a non-binding presentation of our range.

A binding contract is only concluded once an order has been placed and we have either confirmed it by email or already shipped the goods.

We reserve the right to refuse an order without giving reasons.

3. About our product information All information – descriptions, images, prices – is provided without guarantee. We take care to be accurate, but errors (typos, pricing errors, etc.) may still occur; we reserve the right to correct them.

If an item turns out to be unavailable after you have ordered, we will let you know and refund any payments already made.

4. Prices and payment All prices are stated in Swiss francs and include VAT as well as any customs or tobacco duties. Shipping costs are calculated separately and shown before you complete your order.

From an order value of CHF 100.00, shipping may be free of charge – this is indicated accordingly in the shop.

We send invoices exclusively by email. Unless otherwise agreed, payment is due within 15 days of the invoice date.

Available payment methods include TWINT and the other methods shown at checkout. Depending on the situation, we may restrict certain payment methods for individual customers (e.g. new vs. existing customers).

We may adjust prices and shipping costs at any time and withdraw from the contract in the event of pricing or calculation errors.

5. Payment service providers For purchases on invoice or instalment payments we work with CembraPay AG; their own terms and conditions and privacy provisions apply to this part of the payment.

If a payment service provider is involved, it may be necessary to pass on certain personal data to process the payment – always in line with its data protection rules and Swiss law.

6. Shipping If the goods are in stock, we usually ship orders within one working day (for orders placed by 14:00). Stated delivery times are, however, non-binding guidelines and may vary.

Goods are shipped to the address given at checkout. For larger orders we may split the delivery into several partial shipments, where reasonable.

Please report any visible transport damage to the shipping provider and to us immediately.

7. Cancellation by you You can cancel an order as long as it has not yet been shipped.

For cancellations at the customer's request we charge a handling fee of CHF 2.50.

We may also cancel an order for good reason – for example if there are doubts about the stated age, payment problems or suspected misuse.

8. Returns and right of withdrawal In principle, a 14-day right of withdrawal applies to online purchases.

However, this does not apply to snus, snuff and other tobacco products, as these are goods with a limited shelf life.

We only accept returns of incorrectly delivered or damaged goods; in this case, please contact us within 48 hours of receipt.

9. Retention of title The goods delivered remain our property until paid for in full. In the event of late payment, we may withdraw from the contract and reclaim the goods.

10. Content and intellectual property The design, texts, graphics and all other content of our website belong to us. Use as part of the ordering process is permitted; any further use requires our prior written consent.

11. How we handle your data We process personal data in accordance with applicable Swiss data protection law and solely for order processing and internal purposes.

Data is only passed on to third parties where actually necessary – for example to shipping or payment service providers. You have the right to request information about the data stored about you at any time.

12. Limitation of liability

12.1 Website content We cannot guarantee that all content on our website is always up to date, correct or complete. Except in cases of intent or gross negligence, our liability for this is excluded to the extent permitted by law.

12.2 External links Where our website links to other pages, we accept no responsibility for them as long as we have no influence over their content and are not aware of any unlawful content.

12.3 Trademarks and copyright The brands mentioned belong to their respective owners. Reproduction or further use of our content without consent is not permitted.

12.4 Prevention of misuse (Tobacco Products Act) Orders with us are reserved exclusively for persons aged 18 and over. By placing an order, you confirm that you are at least 18 years old and will not resell the tobacco products purchased. If there is any doubt about either point, we may refuse the order.

13. Applicable law and place of jurisdiction These terms and any contracts based on them are governed by Swiss law; the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. The place of jurisdiction, to the extent legally permissible, is St. Gallen.

14. Final provisions The version of these terms valid at the time of the order applies. Any differing terms on your part only apply if we have agreed to them in writing.

We reserve the right to amend these terms at any time.

Should any individual provision be or become invalid, the validity of the remaining provisions shall remain unaffected.
